TERMS OF SERVICE

Welcome to ATX Pilates. These Terms of Service (“Terms”) govern purchases, bookings, memberships, packages, studio services, digital services, and participation in services offered by ATX Pilates, LLC (“ATX Pilates,” “we,” “us,” or “our”).

By creating an account, purchasing services, enrolling in a membership, booking a session, or otherwise using ATX Pilates services, you agree to these Terms.

BOOKINGS & ACCOUNTS

Clients are responsible for maintaining accurate account and payment information.

Classes and sessions are subject to availability and must be booked through an approved ATX Pilates booking platform or directly through ATX Pilates.

Reservations may not be transferred to another person without prior approval.

CANCELLATIONS & NO-SHOWS

ATX Pilates maintains a 12-hour cancellation policy.

Classes or sessions canceled at least 12 hours before the scheduled start time may be returned to the client's account when permitted by the applicable membership or package.

Cancellations made less than 12 hours before the scheduled start time are considered late cancellations and may result in the loss of the class credit or the applicable late cancellation fee.

Failure to attend a scheduled reservation without canceling is considered a no-show and may result in the loss of the class credit or an applicable no-show fee.

Certain memberships may include specific late cancellation or no-show terms disclosed at the time of purchase.

Private sessions, workshops, special events, Teacher Training programs, and other specialty services may have separate cancellation policies disclosed at booking or enrollment.

MEMBERSHIPS & RECURRING BILLING

Certain ATX Pilates memberships renew automatically.

By purchasing an automatically renewing membership, you authorize ATX Pilates and its payment processor to charge the payment method on file at the applicable recurring rate until the membership is canceled in accordance with the membership terms.

The price, billing frequency, minimum commitment, cancellation requirements, and other material membership terms will be disclosed at the time of purchase.

Memberships are intended for the individual purchaser and may not be shared or transferred unless expressly permitted by ATX Pilates.

Clients are responsible for maintaining a valid payment method on file.

If a payment is declined, ATX Pilates may attempt to process the payment again and may suspend booking privileges until the outstanding balance is resolved.

MEMBERSHIP CANCELLATION

Membership cancellation requests must follow the cancellation procedure disclosed in the applicable membership agreement or at the time of purchase.

Canceling a future reservation does not constitute cancellation of a membership.

Membership charges already processed are non-refundable except where otherwise required by applicable law or expressly stated in the applicable membership agreement.

CLASS CREDITS & ROLLOVER

Membership credits are subject to the terms of the membership purchased.

Where rollover is included, eligible unused credits may roll forward for the period specified in the applicable membership terms. Rolled-over credits expire according to those terms and do not accumulate indefinitely.

Credits have no cash value and may not be redeemed for cash.

CLASS PACKAGES

Class packages are valid for the period disclosed at the time of purchase.

Packages and unused credits are non-refundable and non-transferable unless otherwise required by law.

Clients are responsible for using package credits before their applicable expiration date.

INTRODUCTORY OFFERS & PROMOTIONS

Introductory offers are intended for qualifying new clients unless otherwise stated.

Introductory offers, promotional pricing, discounts, and special offers may have specific eligibility requirements and expiration dates.

Unless otherwise stated, promotional offers may not be combined, transferred, exchanged for cash, or applied retroactively to previous purchases.

ATX Pilates reserves the right to discontinue or modify promotional offers for future purchases.

REFUNDS

Except where required by applicable law or expressly stated otherwise, purchases are final and non-refundable.

This includes memberships already billed, class packages, drop-ins, introductory offers, workshops, events, and other services.

Separate written agreements may apply to Teacher Training programs, mentorships, certifications, and similar educational programs.

CLASS & INSTRUCTOR CHANGES

ATX Pilates may substitute instructors, adjust schedules, change class formats, combine classes, relocate a class within its facilities, or cancel classes when reasonably necessary.

When ATX Pilates cancels a class, the applicable class credit will generally be returned to the client's account.

Specific instructors are not guaranteed.

STUDIO ETIQUETTE & SAFETY

Clients are expected to treat instructors, staff, other clients, studio property, and equipment respectfully.

Clients must follow instructor guidance and all posted or communicated studio safety policies.

ATX Pilates reserves the right to refuse participation or suspend services when a client's behavior creates a safety concern, materially disrupts a class or studio environment, involves harassment or threatening conduct, or repeatedly violates studio policies.

FILMING & PRIVACY

To protect the privacy and comfort of our community, unauthorized filming or photography during classes is not permitted.

Any photography or filming organized by ATX Pilates for marketing purposes will be handled separately and does not automatically grant ATX Pilates permission to use a client's likeness without any consent required by applicable law.

OPEN STUDIO & INDEPENDENT PRACTICE

Certain services may allow qualified clients or instructors to use designated studio equipment for independent practice.

Open Studio is not a private lesson or supervised instructional session.

Participants are responsible for practicing within their own training, experience, and physical capabilities and must comply with all equipment and studio safety rules.

ATX Pilates may restrict Open Studio access to particular equipment, exercises, or individuals when reasonably necessary for safety.

EVENTS & THIRD-PARTY LOCATIONS

ATX Pilates may offer events or classes in partnership with third-party businesses or at off-site locations.

Third-party venues and partners may maintain their own policies, waivers, or requirements. Clients are responsible for complying with those requirements in addition to applicable ATX Pilates policies.

LIABILITY WAIVER

Participation in physical activities offered by ATX Pilates is subject to the ATX Pilates Client Liability Waiver & Release, which is incorporated into these Terms by reference.

Clients may be required to electronically accept the Liability Waiver before participating.

INTELLECTUAL PROPERTY

ATX Pilates branding, class names, written materials, training materials, photographs, graphics, educational content, website content, and other proprietary materials may not be copied, reproduced, distributed, sold, or used commercially without written authorization from ATX Pilates.

Teacher Training and educational materials may also be subject to additional intellectual property provisions contained in separate enrollment agreements.

WEBSITE & DIGITAL SERVICES

Clients agree not to misuse ATX Pilates websites, applications, booking platforms, accounts, or other digital services.

ATX Pilates does not guarantee uninterrupted availability of third-party booking, payment, or technology platforms.

COMMUNICATIONS

By providing contact information, clients may receive transactional communications relating to bookings, purchases, account activity, schedule changes, memberships, or other services.

Marketing communications will be handled in accordance with applicable law and available opt-out options.

CHANGES TO THESE TERMS

ATX Pilates may update these Terms periodically.

The current version will be posted on the ATX Pilates website with its effective or last-updated date. Changes will apply prospectively as required by applicable law.

Material changes affecting existing memberships or contractual commitments will be handled in accordance with applicable agreements and law.

GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
